These Terms & Conditions (“Terms”) govern your use of the website www.banarsifurniture.com (the “Website”) and all enquiries, quotations, orders and purchases made from Banarsi Hardware (Banarsi Das Lalji Das & Co.), having its showroom at 849, Krishna Nagar, Near Aarti Chowk, Ferozepur Road, Ludhiana, Punjab 141001 (“we”, “us”, “our”). By using this Website or placing an order with us, you agree to these Terms. If you do not agree, please do not use the Website.
1. Nature of the Website
This Website is a product catalogue and enquiry platform. It does not process online payments. Product listings, images and descriptions are provided to showcase our range; clicking “Enquire for price” or “Enquire on WhatsApp” sends us your enquiry, after which prices, specifications, timelines and payment terms are confirmed directly with you. No content on the Website constitutes a binding offer; a contract is formed only when we confirm your order in writing (including WhatsApp or email) after receipt of the agreed advance.
2. Product information and imagery
We take care to describe and photograph products accurately. However, many of our pieces are handcrafted and use natural materials such as solid wood, veneer, marble and brass. Natural variation in grain, veining, tone and patina is inherent to these materials and is not a defect. Colours may also appear differently on different screens. Dimensions are approximate and may vary slightly, particularly for made-to-order items. Some website photographs are conceptual renders or styled photography; the delivered product may differ in accessories, styling props and background shown.
3. Quotations, orders and payment
Quotations are valid for the period stated on them (or 15 days if unstated) and are subject to change with material prices. Made-to-order furniture and kitchens require an advance payment as confirmed at order time; production begins only after the advance is received and the specification is approved by you. The balance is payable before dispatch or as otherwise agreed in writing. Goods remain our property until payment is received in full. Taxes such as GST are charged as applicable under Indian law and shown on the invoice.
4. Cancellations and changes
Because customised items are produced specifically for you, cancellations or design changes after production has commenced may not be possible, or may attract charges for material and labour already committed. 5. Delivery, risk and installation
Delivery timelines are estimates given in good faith and may be affected by material availability, transport conditions and factors beyond our control; delay does not by itself entitle you to cancel or claim compensation. Risk in the goods passes to you on delivery. Please inspect goods on delivery and record any transit damage as described in our Shipping Policy. Where installation is included, you must provide safe access, electricity and a ready site; delays caused by site conditions may attract waiting or revisit charges.
6. Intellectual property
All content on this Website — including designs, photographs, text, logos and the Rich Gold Germany brand — belongs to us or our licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.
7. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to a product is limited to the price paid for that product. We are not liable for indirect or consequential losses. These Terms are governed by the laws of India. Subject to applicable consumer law, courts at Ludhiana, Punjab shall have exclusive jurisdiction.
